DEMY BEAUTY INFLUENCER TERMS AND CONDITIONS:
*Please read the following Demy Beauty Influencer Terms and Conditions, prior to submitting your Influencer Application and signing the Influencer Agreement.*
Demy Beauty Influencer Terms and Conditions, and Demy Beauty Influencer Agreement, manages the connection between Demy Beauty LLC (Demy Beauty), and you, the individual (Influencer).
Demy Beauty’s Usage of Application/Personal Information: Demy Beauty LLC will not share, distribute or disclose any other information, than that stated in the Influencer Terms and Conditions. Personal Information, such as, Influencer’s address, phone number, identification type, age, date of birth, bank account number, bank routing number, will not be shared, and only used for Demy Beauty LLC operating purposes.
Influencer Tasks/Commitment and Payment: Demy Beauty and the individual (Influencer), agree to the following e/commitment and payment agreement. Demy Beauty Influencer agrees to create original, non-plagiarized content, including but not limited to, photos, videos, images, posts for social media (known as the “campaign content”, or “content”), in accordance with the detailed Influencer Agreement set forth by “us” (Demy Beauty LLC), and “you”, “your”, the individual (Influencer). Demy Beauty LLC will pay the Influencer after posts/content has been created, posted and followed endorsement guidelines, such as include ‘Demy Beauty’ explicitly within the post, and tag and made the sponsorship relationship evident. Influencer must also, send an original copy of the content to info@demybeauty.com. Once Influencer fulfills the Influencer Agreement, Demy Beauty will send the agreed upon payment amount and format to the Influencer. If Influencer receives gifts from Demy Beauty of any sort, these do not need to be paid for, they are Yours to keep. Gifts will not be counted against the agreed upon payment in any way.
Influencer Discount Codes: When applicable, You, the individual (Influencer) will receive a discount code. We advise that you share this code with you followers, as Demy Beauty will use this as a way to track sales derived from your social media Influencer Advertising. Demy Beauty has the right, with or without notice, to remove and deny any sale using the discount code given. Once your Influencer Contract is over, you may no longer use the discount code and Demy Beauty will deactivate the code. Discount codes are not to be misused, sold or trade for monetary value. If so, it will result in immediate termination and annulment of the Influencer Contract, between Demy Beauty LLC and You, the individual (Influencer).
Influencer Compliance Requirements: You, the individual (Influencer), must follow all rules/tasks and regulations including the Influencer Agreement, Social Media Explicit and Implicit Laws and Regulations, as well as, to make evident the connection between the social media posts/campaign content with Demy Beauty. ‘Demy Beauty’ brand name must be included within the content, image, video, etc. Influencers must also tag ‘Demy Beauty’ and disclose that the post/content is sponsored by Demy Beauty where applicable. Demy Beauty brand name, must not be hidden or placed in a hidden location such as ‘More’ section in any social media post platform. Influencers must take and forward content for the purpose of advertising and branding for Demy Beauty LLC. Content/Campaign Content must meet Influencer Agreement guidelines and expectations. Content/Campaign Content must not include graphic nudity, profanity, religious, political views or anything of similar nature. Influencers must have organic and active followers, not bought or fake followers. If inconsistent, dishonest or deceitful acquisition of followers or social media profile/content is found, Demy Beauty LLC has all rights to terminate Influencer Agreement, with or without notice. Influencers must respond to social media comments in an inviting manner and respectfully promote Demy Beauty. Influencers must follow laws to the full extent, regarding Guidelines for Endorsements, as well as the Federal Trade Commission Endorsement Guides, and relatable laws/guidelines.
Demy Beauty’s Usage of Content: You, the individual (Influencer) agrees that Demy Beauty reserves all rights to share and use Your name (Influencer), created content as stated by Demy Beauty Influencer Agreement, social media handle(s), blogs, or anything of the like, for advertising, sales, or promotional purposes of Demy Beauty LLC and services, through different mediums, such as, but not limited to, social media, websites, blogs, flyers, advertisement content related to Demy Beauty LLC campaigns, advertisement and projects. Influencer gives Demy Beauty LLC all reserved rights to copy, share, distribute, recreate, reproduce, use, edit, display publicly, perform, print, and perform, any or all part of the post or content, in any part of the world, that is derived from platforms such as, but not limited to, social media, website, blogs, etc., for the use of Influencer content, including but not limited to, Demy Beauty in-store or online store, websites, social media, digital medial prints, et. You, the individual (Influence) releases Demy Beauty LLC, and any or all personnel, subsidiaries, agents, shareholder owners, contractors and owners from any or all claims for damages/injuries of any nature that result in Demy Beauty LLC usage of the Influencer content or posts.
Terms and Contract Termination/Annulment: Set terms are described in detail within the Influencer Agreement. Influencer must abide by commitments, laws and guidelines stated within the Demy Beauty Influencer Terms and Agreements, Influencer Agreement, and applicable laws, as stated above. Demy Beauty reserves the right to terminate Influencer Agreement (contract), with or without reason, and will provide the Influencer a notice up to (5) days prior to termination date. This does not apply if Influencer engages in behavior that do not reflect Influencer Agreement terms, failure to deliver or create content or works against the interests of Demy Beauty LLC in any way or form, in this case the contract will be terminated/Annulled instantly with or without warning.
Contract Governing Law: This Influencer Terms and Conditions and the Influencer Agreement, between Demy Beauty LLC, and You, the individual (Influencer), serves and is governed by New York State Law. Neither Party may alter, change, sell or transfer this agreement without the knowledge and written consent of the other party/person involved; except if Demy Beauty LLC transfers over the agreement (all rights) to a partner/affiliate, and provides You, the individual (Influencer) a notice via mail, email, social media or any other contact platform, in this case, Your (Influencer) acknowledgement or written consent is not necessary.
Influencer Status: Influencer Agreement does not mean or imply in any way or form that You, the individual (Influencer) is an employee of Demy Beauty LLC. Demy Beauty LLC and the Influencer do not have an employer/employee relationship, neither party may pose, generate, fabricate a false partnership, contract relationship or any sort, other than that stated by the Influencer Agreement. Influencer reserves the right to withdraw from Influencer Agreement contract only if they inform Demy Beauty LLC of their request and they are released by Demy Beauty LLC of the Influencer Agreement.
